Ky projektligj n\u00eb formatin e tij aktual le t\u00eb pambrojtura grat\u00eb n\u00eb tregun e pun\u00ebs dhe ka munges\u00eb t\u00eb theksuar t\u00eb perspektiv\u00ebs gjinore mes grave dhe burrave, sidomos n\u00eb kontekstin e pun\u00ebsimit.<\/p>\n<p>T\u00eb nisur nga ky shqet\u00ebsim dhe me shpres\u00ebn q\u00eb do t\u00eb hasim n\u00eb bashk\u00ebpunimin tuaj, ne k\u00ebrkojm\u00eb q\u00eb ju t\u00eb merrni parasysh rekomandimet tona t\u00eb m\u00ebposhtme, p\u00ebr amandamentimin e Ligjit t\u00eb Pun\u00ebs, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb qart\u00ebsohen dispozitat mbi diskriminimin n\u00eb pun\u00eb, dhe rastet e tilla t\u00eb mund t\u00eb trajtohen n\u00eb kuad\u00ebr t\u00eb Ligjit t\u00eb Pun\u00ebs, ndaras Ligjit <a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=10924\">Nr. 05\/L -021 P\u00ebr mbrojtjen nga<\/a> <a href=\"https:\/\/gzk.rks-gov.net\/ActDetail.aspx?ActID=10924\">diskriminimi.<\/a><\/p>\n<p><strong><u>Propozim<\/u><\/strong><\/p>\n<p>T\u00eb b\u00ebhet nj\u00eb ndarje m\u00eb logjike e kuadrit ligjor, drejt adresimit t\u00eb mos harmonizimit aktual t\u00eb kuadrit ligjor q\u00eb mbivendos\u00eb definicione dhe sanksione t\u00eb ndryshme, t\u00eb cilat, tani p\u00ebr tani kontribuojn\u00eb n\u00eb konfuzion dhe pasiguri ligjore.<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>T\u00eb konsiderohet ndryshimi i Ligjit t\u00eb Pun\u00ebs p\u00ebr t\u00eb trajtuar n\u00eb m\u00ebnyr\u00eb specifike diskriminimin vet\u00ebm n\u00eb kontekstin e pun\u00ebsimit, duke shtuar nj\u00eb nen si n\u00eb vijim:<\/li>\n<\/ul>\n<p>Neni xx , Llojet e diskriminimit n\u00eb pun\u00eb<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<ol>\n<li><strong>Llojet e trajtimit t\u00eb pabarabart\u00eb t\u00eb pun\u00ebtor\u00ebve jan\u00eb:<\/strong><\/li>\n<\/ol>\n<p><strong>\u00a0<\/strong><\/p>\n<ul>\n<li>Diskriminimi i drejtp\u00ebrdrejt\u00eb n\u00eb pun\u00eb konsiderohet kur nj\u00eb <strong>kandidat p\u00ebr pun\u00eb apo pun\u00ebtor <\/strong>trajtohet n\u00eb m\u00ebnyr\u00eb m\u00eb pak t\u00eb favorshme sesa trajtohet, ka qen\u00eb i trajtuar ose do t\u00eb trajtohet nj\u00eb <strong>kandidat pune <\/strong>apo <strong>pun\u00ebtor tjet\u00ebr <\/strong>n\u00eb nj\u00eb situat\u00eb t\u00eb krahasueshme, sipas nj\u00eb apo m\u00eb shum\u00eb nga bazat e p\u00ebrcaktuara n\u00eb nenin nj\u00eb (1) t\u00eb Ligjit p\u00ebr mbrojtje nga diskriminimi;<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Diskriminimi i t\u00ebrthort\u00eb konsiderohet kur, nj\u00eb dispozit\u00eb, kriter apo praktik\u00eb e paanshme n\u00eb dukje e v\u00eb, e ka v\u00ebn\u00eb apo do ta v\u00eb <strong>kandidatin p\u00ebr pun\u00eb apo pun\u00ebtorin <\/strong>n\u00eb pozit\u00eb t\u00eb pabarabart\u00eb krahasuar me t\u00eb tjer\u00ebt, sipas nj\u00eb apo m\u00eb shum\u00eb nga bazat e p\u00ebrcaktuara n\u00eb nenin nj\u00eb (1) t\u00eb Ligjit p\u00ebr mbrojtje nga diskriminimi, p\u00ebrve\u00e7 n\u00eb rastet kur dispozita, praktika apo kriteri i till\u00eb mund t\u00eb arsyetohet n\u00eb pik\u00ebpamje objektive me nj\u00eb q\u00ebllim legjitim, dhe mjetet p\u00ebr arritjen e q\u00ebllimit jan\u00eb t\u00eb p\u00ebrshtatshme dhe domosdoshme;<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Ngacmimi konsiderohet diskriminim, kur nj\u00eb sjellje e pad\u00ebshirueshme (q\u00eb p\u00ebrfshin por, nuk kufizohet n\u00eb sjellje t\u00eb natyr\u00ebs s\u00eb pad\u00ebshirueshme seksuale dhe\/apo psikologjike, q\u00eb ka p\u00ebr q\u00ebllim apo pasoj\u00eb shkeljen e dinjitetit t\u00eb personit dhe krijimin e ambientit frik\u00ebsues, armiq\u00ebsor, degradues, n\u00ebn\u00e7mues apo fyes) mbi bazat e p\u00ebrcaktuara n\u00eb nenin nj\u00eb (1) t\u00eb Ligjit p\u00ebr Mbrojtje nga Diskriminimi;<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Nxitja p\u00ebr t\u00eb diskriminuar konsiderohet diskriminim mbi bazat e p\u00ebrcaktuara n\u00eb nenin nj\u00eb (1) t\u00eb Ligjit p\u00ebr Mbrojtje nga Diskriminimi, dhe p\u00ebrfshin \u00e7do promovim t\u00eb urrejtjes <strong>kundrejt kandidatit p\u00ebr pun\u00eb apo pun\u00ebtorit <\/strong>kur ajo b\u00ebhet me dashje\u201d.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>Ne Nenin 5, Ndalimi i t\u00eb gjitha llojeve t\u00eb diskriminimit, te shtohet edhe nje paragraf qe specifikon si ne vijim:<\/p>\n<p>\u201cNdalohet diskriminimi i drejtp\u00ebrdrejt\u00eb ose i t\u00ebrthort\u00eb i t\u00eb gjith\u00eb personave, burra dhe gra, <strong>gjat\u00eb procesit t\u00eb pun\u00ebsimit<\/strong>, <strong>avancimit n\u00eb pun\u00eb dhe avancimit profesional<\/strong>, n\u00ebse p\u00ebr at\u00eb vend pune secili nga ta \u00ebsht\u00eb i aft\u00eb ta kryej\u00eb pun\u00ebn n\u00eb m\u00ebnyr\u00eb adekuate.\u201d<\/p>\n<p><strong><u>Justifikim<\/u><\/strong><\/p>\n<p>Shtjellimi i mbrojtjes nga diskriminimi specifikisht n\u00eb kontekstin e pun\u00ebsimit, me an\u00eb t\u00eb p\u00ebrmendjes, nd\u00ebr t\u00eb tjera, t\u00eb formave t\u00eb diskriminimit, si\u00e7 jan\u00eb ngacmimi, ngacmimi seksual dhe nxitja p\u00ebr t\u00eb diskriminuar; t\u00eb shquhet diskriminimi i drejtp\u00ebrdrejt\u00eb nga ai i t\u00ebrthort\u00eb; dhe t\u00eb aplikohen bazat e tjera t\u00eb renditura p\u00ebr diskriminimin.<\/p>\n<p>Dispozitat aktuale t\u00eb Ligjit t\u00eb Pun\u00ebs q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me diskriminimin jan\u00eb minimaliste. Edhe pse parashikohet q\u00eb Ligji nr. 05\/L-021 p\u00ebr Mbrojtjen nga Diskriminimi zbatohet drejtp\u00ebrdrejt n\u00eb marr\u00ebdh\u00ebniet e pun\u00ebs, megjithat\u00eb, p\u00ebrpos k\u00ebsaj reference e kryq\u00ebzuar duhet t\u00eb ket\u00eb nj\u00eb mbrojtje m\u00eb t\u00eb detajizuar nga diskriminimi, specifikisht n\u00eb kontekstin e pun\u00ebsimit. M\u00ebnyra e vetme se si aktualisht p\u00ebrmendet diskriminimi i drejtp\u00ebrdrejt\u00eb dhe i t\u00ebrthort\u00eb n\u00eb LP, \u00ebsht\u00eb kundrejt personave me aft\u00ebsi te kufizuara. Ligji nuk p\u00ebrmban dispozita t\u00eb tjera specifike lidhur me shkaqet e tjera t\u00eb diskriminimit.<\/p>\n<p>&nbsp;<\/p>\n<p>Prandaj, \u00ebsht\u00eb e nevojshme t\u00eb shtjellohet mbrojtja nga diskriminimi specifikisht n\u00eb kontekstin e pun\u00ebsimit, me an\u00eb t\u00eb p\u00ebrmendjes, nd\u00ebr t\u00eb tjera, t\u00eb formave t\u00eb diskriminimit, si\u00e7 jan\u00eb ngacmimi, ngacmimi seksual dhe nxitja p\u00ebr t\u00eb diskriminuar; t\u00eb shquhet diskriminimi i drejtp\u00ebrdrejt\u00eb nga ai i t\u00ebrthort\u00eb; dhe t\u00eb aplikohen bazat e tjera t\u00eb renditura p\u00ebr diskriminimin.<\/p>\n<p>Shpresojm\u00eb n\u00eb mir\u00ebkuptimin dhe bashk\u00ebpunimin tuaj,<\/p>\n<p>Sinqerisht,<\/p>\n<p>Rrjeti i Grave t\u00eb Kosov\u00ebs<\/p>\n<p>&nbsp;<\/p>\n<p><em>Rrjeti i Grave t\u00eb Kosov\u00ebs (RrGK) \u00ebsht\u00eb nj\u00eb rrjet prej m\u00eb shum\u00eb se 143 organizatave t\u00eb grave t\u00eb t\u00eb gjitha grupeve etnike nga mbar\u00eb Kosova q\u00eb avokon n\u00eb em\u00ebr t\u00eb grave kosovare, n\u00eb nivel komb\u00ebtar, rajonal dhe nd\u00ebrkomb\u00ebtar.
