Arben Vitia,<\/p>\n\n\n\n<p>Po ju drejtohem n\u00eb em\u00ebr t\u00eb Rrjetit t\u00eb Grave t\u00eb Kosov\u00ebs (RrGK), si nj\u00eb rrjet prej 139 organizatash t\u00eb ndryshme p\u00ebr t\u00eb drejtat e grave, t\u00eb angazhuara n\u00eb mbrojtjen dhe promovimin e t\u00eb drejtave t\u00eb grave dhe vajzave, q\u00eb t\u00eb shpreh shqet\u00ebsimin ton\u00eb lidhur me ndryshimet e fundit n\u00eb p\u00ebrgjegj\u00ebsit\u00eb e ministrive, p\u00ebrkitazi me sh\u00ebrbimet sociale dhe munges\u00ebn e konsultimit me pal\u00ebt kryesore t\u00eb interesit p\u00ebrpara se t\u00eb b\u00ebhen ndryshimet e tilla drastike, duke p\u00ebrfshir\u00eb konsultimet e pamjaftueshme me organizatat p\u00ebr t\u00eb drejtat e grave (OSHCG-t\u00eb), p\u00ebrfshir\u00eb k\u00ebtu RrGK-n\u00eb si eksperte p\u00ebr k\u00ebto \u00e7\u00ebshtje.<\/p>\n\n\n\n<p>N\u00eb vitin 2020, Qeveria e koalicionit nd\u00ebrmjet L\u00ebvizjes Vet\u00ebvendosje! dhe Lidhjes Demokratike t\u00eb Kosov\u00ebs (LDK) vendosi, pa konsultime t\u00eb duhura publike apo konsultime me ekspert\u00eb si RrGK-ja, t\u00eb shkrij\u00eb Ministrin\u00eb e Pun\u00ebs dhe Mir\u00ebqenies Sociale n\u00eb Ministrin\u00eb e Financave, Pun\u00ebs dhe Transfereve (MFPT). N\u00eb vitin 2021, L\u00ebvizja Vet\u00ebvendosje! erdhi n\u00eb pushtet si nj\u00eb parti politike e qendr\u00ebs s\u00eb majt\u00eb me premtimet se siguria sociale do t\u00eb ishte prioritet, si\u00e7 edhe theksohet n\u00eb disa seksione t\u00eb programit t\u00eb saj partiak t\u00eb vitit 2021.<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> RrGK-ja shpresonte se nga k\u00ebto zotime do t\u00eb p\u00ebrfitonin qytetar\u00ebt q\u00eb jetojn\u00eb n\u00eb margjina dhe do t\u00eb p\u00ebrmir\u00ebsohej jeta e tyre, ve\u00e7an\u00ebrisht e grave, p\u00ebrmes forcimit t\u00eb sh\u00ebrbimeve sociale. Fatkeq\u00ebsisht Qeveria e tanishme e Kosov\u00ebs vazhdoi administrimin e sh\u00ebrbimeve sociale n\u00eb kuad\u00ebr t\u00eb MFPT-s\u00eb dhe ka pasur pak ose aspak progres n\u00eb ligjet kryesore q\u00eb presin miratimin p\u00ebr p\u00ebrmir\u00ebsimin e sh\u00ebrbimeve sociale, nd\u00ebrkoh\u00eb q\u00eb ka vazhduar mungesa e financimit sistematik t\u00eb tyre.<\/p>\n\n\n\n<p>N\u00eb konferenc\u00ebn e organizuar nga K\u00ebshilli i Evrop\u00ebs, me dat\u00eb 29 mars 2023, u theksua se nga ky vit Departamenti p\u00ebr Politika Sociale dhe Familjare ka kaluar n\u00eb Ministrin\u00eb e Drejt\u00ebsis\u00eb. Burime t\u00eb tjera, na kan\u00eb informuar se ka ndryshuar struktura ku ky Departament \u00ebsht\u00eb sh\u00ebnd\u00ebruar n\u00eb Divizon p\u00ebr Politika dhe Sh\u00ebrbime Sociale. Sipas k\u00ebtij burimi, bazuar n\u00eb Ligjin p\u00ebr Buxhet 2023, Sherbimet Sociale, Mbrojtja e F\u00ebmij\u00ebve, K\u00ebshilli i P\u00ebrgjithsh\u00ebm, dhe Inspektimi kan\u00eb kaluar n\u00eb Ministrin\u00eb e Drejt\u00ebsis\u00eb. Tutje, kemi kuptuar se sh\u00ebrbimet sociale p\u00ebr persona me aft\u00ebsi t\u00eb kufizuara kan\u00eb kaluar n\u00eb Ministrin\u00eb e Drejt\u00ebsis\u00eb, nd\u00ebrsa menaxhimi i institucioneve rezidenciale ka kaluar n\u00eb Ministrin\u00eb e Sh\u00ebndet\u00ebsis\u00eb.&nbsp; I t\u00ebr\u00eb ky ndryshim \u00ebsht\u00eb b\u00ebr\u00eb pa ndonj\u00eb konsultim publik, nd\u00ebrsa ende nuk \u00ebsht\u00eb aprovuar rregullorja q\u00eb p\u00ebrcakton fushat e p\u00ebrgjegj\u00ebsis\u00eb s\u00eb qeveris\u00eb. Andaj, konsiderojm\u00eb se nj\u00eb vendim i till\u00eb, pa nj\u00eb legjislacion sekondar q\u00eb ndan qartazi k\u00ebto p\u00ebrgjegj\u00ebsi, pa konsultim apo paralajm\u00ebrim paraprak, \u00ebsht\u00eb shqet\u00ebsues.<\/p>\n\n\n\n<p>&nbsp;Jemi shum\u00eb t\u00eb shqet\u00ebsuara me k\u00ebto ndryshime t\u00eb cilat prekin an\u00ebtaret tona t\u00eb ndryshme dhe grat\u00eb t\u00eb cilave u sh\u00ebrbejn\u00eb, duke p\u00ebrfshir\u00eb personat me aft\u00ebsi t\u00eb kufizuara, viktimat\/t\u00eb mbijetuarat e dhun\u00ebs me baz\u00eb gjinore si dhe kategori t\u00eb tjera t\u00eb c\u00ebnueshme. Jemi thell\u00ebsisht t\u00eb shqet\u00ebsuara se k\u00ebto ndryshime mund t\u00eb vonojn\u00eb edhe m\u00eb tej finalizimin dhe miratimin e legjislacionit vendimtar megjith\u00ebse ende t\u00eb pa miratuar p\u00ebrkitazi me sh\u00ebrbimet sociale, cil\u00ebsin\u00eb e sh\u00ebrbimeve sociale dhe ndarjen e buxhetit t\u00eb mjaftuesh\u00ebm p\u00ebr k\u00ebto sh\u00ebrbime. Shqet\u00ebsimet tona burojn\u00eb nga ekspertiza, hulumtimet dhe provat tona gjith\u00ebp\u00ebrfshir\u00ebse t\u00eb mbledhura p\u00ebrgjat\u00eb dy dekadave t\u00eb fundit. M\u00eb sakt\u00ebsisht, jemi t\u00eb shqet\u00ebsuara se:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>Sh\u00ebrbimet sociale fillimisht nuk ishin pjes\u00eb e mandatit t\u00eb Ministris\u00eb s\u00eb Drejt\u00ebsis\u00eb.<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a> Duke pasur parasysh ngarkes\u00ebn me pun\u00ebt ekzistuese t\u00eb Ministris\u00eb, jemi t\u00eb shqet\u00ebsuara n\u00ebse do t\u00eb ket\u00eb burime t\u00eb mjaftueshme njer\u00ebzore p\u00ebr t\u00eb marr\u00eb p\u00ebrsip\u00ebr p\u00ebrgjegj\u00ebsit\u00eb e m\u00ebdha q\u00eb vijn\u00eb nga mbik\u00ebqyrja e sh\u00ebrbimeve sociale. Sh\u00ebrbimet sociale p\u00ebr personat q\u00eb vuajn\u00eb nga dhuna me baz\u00eb gjinore k\u00ebrkojn\u00eb nj\u00eb qasje profesionale nga psikolog\u00eb dhe punonj\u00ebs social t\u00eb trajnuar, e t\u00eb \u00e7ertifikuar. Ne jemi t\u00eb brengosura dhe me m\u00ebdyshje n\u00ebse Ministria e Drejt\u00ebsis\u00eb ka ekspertiz\u00ebn p\u00ebrkat\u00ebse p\u00ebr t\u00eb monitoruar dhe p\u00ebr t\u00eb siguruar ofrimin e sh\u00ebrbimeve cil\u00ebsore, pasi kjo pun\u00eb \u00ebsht\u00eb jasht\u00eb mandatit t\u00eb saj. Ne kemi propozuar disa k\u00ebrkesa n\u00eb lidhje me p\u00ebrgjegj\u00ebsit\u00eb dhe kriteret minimale sa i p\u00ebrket kompetencave n\u00eb komentet tona si p\u00ebr Projektligjin p\u00ebr Sh\u00ebrbimet Sociale (Shtojca 1) edhe p\u00ebr Projektligjin q\u00eb rregullon dhun\u00ebn me baz\u00eb gjinore (Shtojca 2) n\u00eb p\u00ebrputhje me Konvent\u00ebn e Stambollit. \u00c7do Ministri q\u00eb ofron mbik\u00ebqyrjen duhet t\u00eb ket\u00eb kualifikimet e nevojshme p\u00ebr monitorimin e duhur t\u00eb k\u00ebtyre sh\u00ebrbimeve.<\/li><li>Transferimi i k\u00ebtyre kompetencave n\u00eb Ministrin\u00eb e Drejt\u00ebsis\u00eb ka mund\u00ebsi t\u00eb kontribuoj\u00eb n\u00eb vonimin e m\u00ebtejsh\u00ebm t\u00eb miratimit t\u00eb k\u00ebtyre ligjeve ky\u00e7e, t\u00eb cilat tashm\u00eb jan\u00eb vonuar dhe jan\u00eb thelb\u00ebsore p\u00ebr p\u00ebrmir\u00ebsimin e sh\u00ebrbimeve thelb\u00ebsore n\u00eb p\u00ebrputhje me Konvent\u00ebn e Stambollit. Tashm\u00eb projektligjet e sip\u00ebrp\u00ebrmendura do t\u00eb duhet t\u00eb rishikohen p\u00ebr t\u00eb qart\u00ebsuar detyrat dhe p\u00ebrgjegj\u00ebsit\u00eb e reja. Lidhur me k\u00ebt\u00eb, ne mbetemi t\u00eb shqet\u00ebsuara se a do t\u00eb arrijn\u00eb Qeveria dhe Kuvendi q\u00eb rekomandimet tona t\u00eb parashtruara m\u00eb par\u00eb p\u00ebr k\u00ebto projektligje ky\u00e7e t\u00eb trajtohen, p\u00ebr t\u00eb siguruar ofrimin, financimin, monitorimin dhe koordinimin e sh\u00ebrbimeve ky\u00e7e p\u00ebr personat q\u00eb kan\u00eb p\u00ebsuar dhun\u00eb me baz\u00eb gjinore, sipas k\u00ebrkesave t\u00eb Konvent\u00ebs s\u00eb Stambollit. Ve\u00e7an\u00ebrisht pasi projektligji i fundit p\u00ebr dhun\u00ebn me baz\u00eb gjinore n\u00eb Kuvend nuk i trajtoi sugjerimet tona dhe p\u00ebr k\u00ebt\u00eb arsye nuk \u00ebsht\u00eb n\u00eb p\u00ebrputhje me Konvent\u00ebn e Stambollit.<\/li><li>Trajtimi i aft\u00ebsis\u00eb s\u00eb kufizuar si problem sh\u00ebndet\u00ebsor \u00ebsht\u00eb diskriminues dhe nuk \u00ebsht\u00eb n\u00eb p\u00ebrputhje me Konvent\u00ebn e Kombeve t\u00eb Bashkuara (OKB) p\u00ebr t\u00eb Drejtat e Personave me Aft\u00ebsi t\u00eb Kufizuara (CRPD), nj\u00eb traktat ky nd\u00ebrkomb\u00ebtar p\u00ebr t\u00eb drejtat e njeriut, i ratifikuar nga OKB-ja n\u00eb vitin 2008. Konventa e njeh aft\u00ebsin\u00eb e kufizuar si \u201c<em>nj\u00eb koncept q\u00eb evoluon dhe se aft\u00ebsia e kufizuar rezulton nga nd\u00ebrveprimi nd\u00ebrmjet personave me aft\u00ebsi t\u00eb kufizuar dhe barrierave t\u00eb q\u00ebndrimit\/mentalitetit dhe ambientit q\u00eb pengojn\u00eb pjes\u00ebmarrjen e tyre t\u00eb plot\u00eb dhe efektive n\u00eb shoq\u00ebri n\u00eb baz\u00eb t\u00eb barabart\u00eb me t\u00eb tjer\u00ebt<\/em>\u201d, q\u00eb sh\u00ebnon nj\u00eb zhvendosje t\u00eb paradigm\u00ebs nga t\u00eb kuptuarit e aft\u00ebsis\u00eb s\u00eb kufizuar si nj\u00eb gjendje mjek\u00ebsore n\u00eb at\u00eb q\u00eb e sheh aft\u00ebsin\u00eb e kufizuar si efektin e nd\u00ebrveprimit midis d\u00ebmtimit t\u00eb nj\u00eb individi dhe barrierave q\u00eb i krijon shoq\u00ebria.<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a> \u00cbsht\u00eb p\u00ebrgjegj\u00ebsi e shtetit t\u00eb siguroj\u00eb ekzistimin e kushteve sociale, ekonomike dhe fizike p\u00ebr t\u2019u mund\u00ebsuar personave me aft\u00ebsi t\u00eb kufizuara mund\u00ebsin\u00eb q\u00eb t\u00eb marrin pjes\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb barabart\u00eb n\u00eb shoq\u00ebri. Tutje, neni 19 shpjegon r\u00ebnd\u00ebsin\u00eb e asistent\u00ebve personal p\u00ebr nj\u00eb jet\u00eb t\u00eb pavarur dhe i detyron shtetet \u201c<em>t\u00eb ken\u00eb akses ndaj nj\u00eb game t\u00eb gjer\u00eb sh\u00ebrbimesh mb\u00ebshtet\u00ebse n\u00eb sht\u00ebpi, sh\u00ebrbimesh rezidenciale dhe sh\u00ebrbimesh n\u00eb komunitetet dhe t\u00eb parandalojn\u00eb izolimin dhe ve\u00e7imin e tyre nga komuniteti<\/em>\u201d. Neni 6 njeh pabarazit\u00eb dhe barrierat unike t\u00eb shum\u00ebfishta me t\u00eb cilat mund t\u00eb p\u00ebrballen grat\u00eb me aft\u00ebsi t\u00eb kufizuara dhe u b\u00ebn thirrje shteteve t\u00eb ofrojn\u00eb sh\u00ebrbime mbrojt\u00ebse shtes\u00eb: \u201c<em>1. Shtetet Pal\u00eb pranojn\u00eb se grat\u00eb dhe vajzat me aft\u00ebsi t\u00eb kufizuar jan\u00eb objekt i nj\u00eb diskriminimi shum\u00ebform\u00ebsh dhe p\u00ebr k\u00ebt\u00eb do t\u00eb marrin masa p\u00ebr t\u2019u siguruar se ato g\u00ebzojn\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb plot\u00eb dhe t\u00eb barabart\u00eb t\u00eb gjitha t\u00eb drejtat dhe lirit\u00eb themelore t\u00eb njeriut.2. Shtetet Pal\u00eb duhet t\u00eb marrin t\u00eb gjitha masat e duhura p\u00ebr t\u00eb siguruar zhvillimin, p\u00ebrparimin dhe fuqizimin e plot\u00eb t\u00eb grave, me q\u00ebllim q\u00eb t\u2019u garantohet ushtrimi dhe g\u00ebzimi i t\u00eb drejtave dhe lirive themelore t\u00eb njeriut t\u00eb p\u00ebrcaktuara n\u00eb k\u00ebt\u00eb Konvent\u00eb<\/em>\u201d.<a href=\"#_ftn4\" id=\"_ftnref4\">[4]<\/a> Edhe pse Kosova nuk e ka ratifikuar Konvent\u00ebn, k\u00ebto praktika dhe qasje m\u00eb t\u00eb mira duhet t\u00eb merren n\u00eb konsiderat\u00eb dhe t\u00eb zbatohen nga Kosova n\u00eb rrug\u00ebn p\u00ebrpara. P\u00ebr m\u00eb tep\u00ebr, Komisioni Evropian miratoi koh\u00ebt e fundit Strategjin\u00eb Evropiane p\u00ebr Aft\u00ebsit\u00eb e Kufizuara 2021-2030, e cila synon t\u00eb fuqizoj\u00eb individ\u00ebt me aft\u00ebsi t\u00eb kufizuara dhe t\u00eb eliminoj\u00eb barrierat.<a href=\"#_ftn5\" id=\"_ftnref5\">[5]<\/a> Kosova gjithashtu duhet t\u00eb p\u00ebrpiqet t\u00eb l\u00ebviz\u00eb n\u00eb k\u00ebt\u00eb drejtim si pjes\u00eb e ambicieve t\u00eb saj p\u00ebr an\u00ebtar\u00ebsim n\u00eb BE. Si p\u00ebrfundim, aft\u00ebsit\u00eb e kufizuara nuk duhet t\u00eb trajtohen nga Ministria e Sh\u00ebndet\u00ebsis\u00eb, por n\u00eb vend t\u00eb k\u00ebsaj ato t\u00eb trajtohen si nj\u00eb sh\u00ebrbim social, apo si \u00e7\u00ebshtje e t\u00eb drejtave t\u00eb njeriut.<\/li><\/ol>\n\n\n\n<p>P\u00ebr t\u00eb mbrojtur grat\u00eb dhe vajzat, n\u00eb p\u00ebrputhje me angazhimet nd\u00ebrkomb\u00ebtare dhe qeveritare, nd\u00ebr t\u00eb tjera, RrGK-ja rekomandon q\u00eb Qeveria e Kosov\u00ebs:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>T\u00eb rihap\u00eb Ministrin\u00eb e Pun\u00ebs dhe Mir\u00ebqenies Sociale dhe t\u2019ia rikthej\u00eb p\u00ebrgjegj\u00ebsit\u00eb si m\u00eb par\u00eb. Zhvendosja e p\u00ebrgjegj\u00ebsive n\u00eb nj\u00eb ministri tjet\u00ebr nuk ka trajtuar dhe nuk do t\u2019i trajtoj\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb q\u00ebndrueshme \u00e7\u00ebshtjet dhe sfidat themelore q\u00eb ekzistojn\u00eb. N\u00eb vend q\u00eb t\u2019i zhvendos\u00eb p\u00ebrgjegj\u00ebsit\u00eb, Qeveria duhet t&#8217;i p\u00ebrqendroj\u00eb energjit\u00eb e saj n\u00eb qart\u00ebsimin e p\u00ebrgjegj\u00ebsive brenda korniz\u00ebs ligjore, duke ndar\u00eb buxhet t\u00eb mjaftuesh\u00ebm p\u00ebr to dhe duke monitoruar n\u00eb m\u00ebnyr\u00eb aktive zbatimin e tyre. P\u00ebr k\u00ebt\u00eb, RrGK-ja ka ofruar sugjerime shum\u00eb t\u00eb qarta n\u00eb dy projektligjet e lartp\u00ebrmendura q\u00eb do t\u00eb qart\u00ebsonin k\u00ebto detyra dhe p\u00ebrgjegj\u00ebsi, duke i mund\u00ebsuar Qeveris\u00eb q\u00eb t&#8217;i mbaj\u00eb akter\u00ebt p\u00ebrgjegj\u00ebs p\u00ebr obligimet e tyre ligjore. Vendosja n\u00eb m\u00ebnyr\u00eb t\u00eb qart\u00eb e p\u00ebrgjegj\u00ebsive n\u00eb ligjet e lartp\u00ebrmendura, s\u00eb bashku me ndarjet e duhura buxhetore, do t\u00eb adresoj\u00eb shumic\u00ebn e mang\u00ebsive dhe \u00e7\u00ebshtjeve q\u00eb ekzistojn\u00eb, pa pasur nevoj\u00eb zhvendosjen e s\u00ebrishme t\u00eb p\u00ebrgjegj\u00ebsive. N\u00ebse zhvendosen k\u00ebto p\u00ebrgjegj\u00ebsi,e gjith\u00eb korniza ligjore do t\u00eb duhet t\u00eb rishikohet dhe t\u00eb ndryshohet. P\u00ebr m\u00eb tep\u00ebr, ne jemi t\u00eb shqet\u00ebsuara n\u00ebse k\u00ebto ndryshime do t\u00eb jen\u00eb gjithashtu t\u00eb q\u00ebndrueshme n\u00eb t\u00eb ardhmen n\u00eb rast t\u00eb ndryshimeve t\u00eb qeveris\u00eb dhe n\u00ebse ministrat e ardhsh\u00ebm t\u00eb drejt\u00ebsis\u00eb mund t\u00eb jen\u00eb po aq t\u00eb p\u00ebrkushtuar p\u00ebr t\u00eb \u00e7uar p\u00ebrpara reformat, t\u00eb cilat mund t&#8217;i rrezikojn\u00eb k\u00ebto procese.<\/li><li>T\u00eb konsultoheni n\u00eb m\u00ebnyr\u00eb aktive me OSHCG-t\u00eb q\u00eb kan\u00eb njohuri p\u00ebr sh\u00ebrbimet sociale, p\u00ebrfshir\u00eb RrGK-n\u00eb, p\u00ebr t\u00eb b\u00ebr\u00eb reforma t\u00eb bazuara n\u00eb d\u00ebshmi.<\/li><li>Pas qart\u00ebsimit t\u00eb detyrave dhe p\u00ebrgjegj\u00ebsive, t\u00eb punoni me Kuvendin dhe Komisionet p\u00ebrkat\u00ebse t\u00eb Kuvendit p\u00ebr t\u00eb finalizuar k\u00ebto ligje ky\u00e7e: Ligji p\u00ebr Parandalimin e Dhun\u00ebs n\u00eb Familje, Dhun\u00ebs ndaj Grave dhe Dhun\u00ebs me Baz\u00eb Gjinore (q\u00eb \u00ebsht\u00eb rekomanduar nga RrGK-ja q\u00eb t\u00eb riformulohet si Ligji p\u00ebr Parandalimin, Mbrojtjen dhe Rehabilitimin nga Dhuna me Baz\u00eb Gjinore); Ligji p\u00ebr Sh\u00ebrbimet Familjare dhe Sociale; dhe Ligji p\u00ebr Strehimin Social).
