Bashk\u00eb me to p\u00ebrfituese jan\u00eb edhe kategori t\u00eb tjera t\u00eb diskriminuara.<\/p>\n\n\n\n<p>N\u00eb baz\u00eb t\u00eb ligjit, k\u00ebto kategori kan\u00eb t\u00eb drejt\u00eb p\u00ebr ndihm\u00eb falas dhe asistenc\u00eb ligjore.<\/p>\n\n\n\n<p>Ligji parasheh q\u00eb nj\u00eb pjes\u00eb e pun\u00ebs n\u00eb ndihm\u00ebn juridike falas mund t\u00eb realizohet nga organizatat e shoq\u00ebris\u00eb civile apo organizatat p\u00ebrfaq\u00ebsuese t\u00eb komuniteteve n\u00eb fjal\u00eb. Kjo ndihm\u00eb sipas ligjit do t\u00eb duhej t\u00eb organizohej n\u00eb partneritet me Agjencin\u00eb p\u00ebr Ndihm\u00eb Juridike Falas.<\/p>\n\n\n\n<p>T\u00eb dh\u00ebnat e hulumtimit tregojn\u00eb q\u00eb Agjencia p\u00ebr Ndihm\u00eb Juridike Falas ende nuk ka arritur t\u00eb garantoj\u00eb nj\u00eb proces t\u00eb licencimit t\u00eb organizatave q\u00eb ofrojn\u00eb ndihm\u00ebn juridike falas.<\/p>\n\n\n\n<p>N\u00eb munges\u00eb t\u00eb k\u00ebsaj Agjencia nuk ka t\u00eb planifikuar as p\u00ebrkrahje financiare dhe mb\u00ebshtetje tjet\u00ebr p\u00ebr OJQ-t\u00eb q\u00eb ofrojn\u00eb ndihm\u00eb juridike falas.<\/p>\n\n\n\n<p>N\u00eb mbar\u00eb vendin jan\u00eb m\u00eb pak se 10 organizata q\u00eb ofrojn\u00eb ndihm\u00eb juridike falas nd\u00ebrsa ngritja e kapaciteteve t\u00eb tyre sfidohet nga shum\u00eb faktor\u00eb.<\/p>\n\n\n\n<p>Nj\u00eb hulumtim i Internews Kosova tregon se kapacitetet e OJQ-ve n\u00eb ofrimin e ndihm\u00ebs nuk jan\u00eb rritur n\u00eb vitet e fundit.<\/p>\n\n\n\n<p>Hulumtimi zbardh se problemet nisin nga vet\u00eb Agjencia. Institucioni i ka t\u00eb financuara zyrat mobile p\u00ebr ndihm\u00ebn juridike nga Qeveria gjermane.<\/p>\n\n\n\n<p>Si rrjedhoj\u00eb Agjencia vazhdon t\u00eb ket\u00eb shtrirje jo t\u00eb barabart\u00eb n\u00eb t\u00eb gjitha komunat e vendit.<\/p>\n\n\n\n<p>Momentalisht zyrat mobile t\u00eb 6 komunave financohen nga GIZ n\u00eb em\u00ebr t\u00eb Republik\u00ebs Federale t\u00eb Gjermanis\u00eb, por kjo p\u00ebrmes projekteve afatshkurta dhe afatmesme t\u00eb cilat ngren\u00eb pik\u00ebpyetje substanciale p\u00ebr vazhdim\u00ebsin\u00eb e qendrave mobile pas p\u00ebrfundimit t\u00eb tyre.<\/p>\n\n\n\n<p>Flutura Zena, drejtoresh\u00eb ekzekutive e Agjencis\u00eb p\u00ebr Ndihm\u00eb Juridike Falas, ka treguar se sipas marr\u00ebveshjes q\u00eb e kan\u00eb me GIZ p\u00ebrkrahja financiare nga ta p\u00ebrfundon m\u00eb 30 qershor 2023.<\/p>\n\n\n\n<p>Gjat\u00eb tri viteve t\u00eb fundit nga buxheti i shtetit p\u00ebr \u00e7do vit Agjencis\u00eb p\u00ebr Ndihm\u00eb Juridike Falas i jan\u00eb ndar\u00eb rreth 440,000 euro.<\/p>\n\n\n\n<p>Por krahas paras\u00eb publike t\u00eb vendit, Agjencia ka p\u00ebrfituar edhe donacione t\u00eb tjera t\u00eb cilat tejkalojn\u00eb shum\u00ebn 200 mij\u00eb euro n\u00eb tre vitet e fundit.<\/p>\n\n\n\n<p>N\u00eb p\u00ebrgjigjet e tyre nga ANJF tregojn\u00eb se kan\u00eb k\u00ebrkuar fonde publike shtes\u00eb n\u00eb m\u00ebnyr\u00eb q\u00eb t\u2019i realizojn\u00eb obligimet p\u00ebr zyrat mobile, sigurimin e resurseve t\u00eb nevojshme njer\u00ebzore, p\u00ebrkrahjen e fushatave p\u00ebr ngritjen&nbsp; e vet\u00ebdijes s\u00eb qytetar\u00ebve p\u00ebr sh\u00ebrbimet q\u00eb ofrohen nga ANJF, por asnj\u00ebher\u00eb nuk kan\u00eb marr\u00eb p\u00ebrgjigje nga institucionet p\u00ebrkat\u00ebse.<\/p>\n\n\n\n<p>P\u00ebrpos stafit dhe buxhetit Agjencia ka probleme edhe t\u00eb qasjes.<\/p>\n\n\n\n<p>Kur jan\u00eb pyetur se sa t\u00eb qasshme i kan\u00eb objektet nga personat me aft\u00ebsi t\u00eb kufizuara, p\u00ebrkat\u00ebsisht n\u00ebse posedojn\u00eb pjerr\u00ebsi, lift dhe sinjalistik\u00eb adekuate p\u00ebr t\u00eb shurdh\u00ebr, stafi ka treguar se Agjencia funksionon n\u00eb 27 komuna n\u00eb t\u00eb cilat mungon sinjalistika, qasja p\u00ebr persona me aft\u00ebsi t\u00eb kufizuara n\u00eb 10 komuna \u00ebsht\u00eb e v\u00ebshtir\u00ebsuar, nd\u00ebrsa n\u00eb 17 komuna ka qasje t\u00eb mir\u00eb.<br>N\u00eb lidhje me p\u00ebrpjekjet p\u00ebr t\u00eb ndryshuar k\u00ebt\u00eb realitet t\u00eb dhimbsh\u00ebm p\u00ebr k\u00ebt\u00eb kategori personash, Agjencia ka treguar se n\u00eb \u00e7do rast kur k\u00ebrkon sigurimin e hap\u00ebsirave p\u00ebr zyra, potencon karakteristikat dhe pal\u00ebt q\u00eb frekuentojn\u00eb Agjencin\u00eb dhe nj\u00ebkoh\u00ebsisht k\u00ebrkon zyr\u00eb e cila \u00ebsht\u00eb e qasshme edhe p\u00ebr personat me aft\u00ebsi t\u00eb kufizuara.<\/p>\n\n\n\n<p><strong>Financimi i OJQ-ve<\/strong><\/p>\n\n\n\n<p>M\u00eb pak se 10 organizata joqeveritare n\u00eb mbar\u00eb vendin merren me ofrimin e sh\u00ebrbimeve juridike falas dhe promovimin e k\u00ebtij sh\u00ebrbimi.<\/p>\n\n\n\n<p>T\u00eb dh\u00ebnat tregojn\u00eb q\u00eb organizatat jan\u00eb p\u00ebrkrahur nga fondet e donator\u00ebve p\u00ebr shkak se vendi nuk ka nj\u00eb skem\u00eb t\u00eb q\u00ebndrueshme t\u00eb financimit t\u00eb tyre.<\/p>\n\n\n\n<p>Organizata CEL Kosova&nbsp; ofron sh\u00ebrbimin e ndihm\u00ebs juridike falas n\u00eb linj\u00eb me misionin e saj p\u00ebr nj\u00eb shoq\u00ebri progresive, t\u00eb larmishme dhe tolerante n\u00eb Kosov\u00eb ndaj komunitetit LGBT.<\/p>\n\n\n\n<p>Ky komunitet \u00ebsht\u00eb n\u00eb mesin e komuniteteve t\u00eb atakuara n\u00eb vend, sidomos me akte t\u00eb dhunshme ndaj tyre.<\/p>\n\n\n\n<p>Sipas p\u00ebrfaq\u00ebsuesve t\u00eb organizat\u00ebs, t\u00ebr\u00eb financimi,&nbsp; i cili nuk kalon shum\u00ebn 6,500 euro, \u00ebsht\u00eb i bazuar n\u00eb fondet e organizatave nd\u00ebrkomb\u00ebtare.<\/p>\n\n\n\n<p>Organizata tjet\u00ebr CLARD Kosovo operon me 160,000 euro n\u00eb vit p\u00ebr dh\u00ebnien e k\u00ebsaj ndihme, t\u00eb siguruara nga Ambasada amerikane, Ambasada britanike dhe Komisioni Evropian, pa e prekur ndonj\u00ebher\u00eb buxhetin e shtetit, sipas tyre, qysh prej themelimit.<\/p>\n\n\n\n<p>Dy organizatat kan\u00eb projekte afatshkurta, t\u00eb cilat nuk garantojn\u00eb q\u00ebndrueshm\u00ebri.<\/p>\n\n\n\n<p>CEL Kosova thot\u00eb se akoma nuk ka arritur t\u00eb krijoj\u00eb nj\u00eb mb\u00ebshtetje t\u00eb q\u00ebndrueshme nga ndonj\u00eb donator, por pohon t\u00eb jet\u00eb n\u00eb proces t\u00eb draftimit t\u00eb nj\u00eb strategjie afatgjate p\u00ebr k\u00ebt\u00eb aspekt.<\/p>\n\n\n\n<p>CLARD Kosovo thot\u00eb se mb\u00ebshtetjen m\u00eb t\u00eb q\u00ebndrueshme e ka nga Ambasada amerikane n\u00eb Kosov\u00eb por as kjo p\u00ebrkrahje, sipas saj, nuk \u00ebsht\u00eb ndonj\u00eb q\u00ebndrueshm\u00ebri e sigurt.<\/p>\n\n\n\n<p>P\u00ebrpos sfidave financiare organizatat kan\u00eb sfid\u00eb edhe ambientet e pun\u00ebs ku i zhvillojn\u00eb aktivitetet.<\/p>\n\n\n\n<p>CEL Kosova nuk ka nj\u00eb objekt t\u00eb vetin. Nga organizata tregojn\u00eb se kan\u00eb qen\u00eb n\u00eb p\u00ebrpjekje dhe bisedime t\u00eb vazhdueshme me Komun\u00ebn e Prishtin\u00ebs p\u00ebr shfryt\u00ebzimin e nj\u00eb hap\u00ebsire publike n\u00eb funksion t\u00eb Drop-In Centre, ku do t\u00eb kryenin edhe aktivitetin e nevojsh\u00ebn p\u00ebr dh\u00ebnien e ndihm\u00ebs juridike falas p\u00ebrve\u00e7 tjerash, por q\u00eb pavar\u00ebsisht premtimeve, ende nuk \u00ebsht\u00eb n\u00eb shfryt\u00ebzim t\u00eb tyre.<\/p>\n\n\n\n<p>As organizata CLARD Kosova nuk ka n\u00eb pron\u00ebsi nj\u00eb hap\u00ebsir\u00eb t\u00eb saj. Nga organizata tregojn\u00eb se asnj\u00ebher\u00eb as nuk kan\u00eb tentuar ta sigurojn\u00eb at\u00eb me q\u00ebllim t\u00eb shmangies s\u00eb ndikimeve. Por, megjithat\u00eb, tregojn\u00eb se n\u00eb baz\u00eb t\u00eb marr\u00ebveshjeve p\u00ebr klinikat ligjore n\u00ebp\u00ebr komuna shfryt\u00ebzojn\u00eb hap\u00ebsirat e Qendrave p\u00ebr Pun\u00eb Sociale.<\/p>\n\n\n\n<p><strong>Sfidat e legjislacionit<\/strong><\/p>\n\n\n\n<p>Organizimi i ndihm\u00ebs juridike duke i p\u00ebrfshir\u00eb OJQ-t\u00eb sipas ligjit do duhej t\u2019i n\u00ebnshtrohej nj\u00eb standardi t\u00eb rregulluar ligjor.<\/p>\n\n\n\n<p>P\u00ebr shum\u00eb vite Agjencia nuk ka arritur ta hartoj\u00eb rregulloren p\u00ebr ta standardizuar k\u00ebt\u00eb pun\u00eb.<\/p>\n\n\n\n<p>T\u00eb dh\u00ebnat nga Agjencia tregojn\u00eb se rregullorja p\u00ebr p\u00ebrcaktimin e kritereve p\u00ebr ofrimin e ndihm\u00ebs juridike falas nga organizatat joqeveritare n\u00eb partneritet me Agjencin\u00eb p\u00ebr Ndihm\u00eb Juridike Falas \u00ebsht\u00eb n\u00eb stad drafti t\u00eb dor\u00ebzuar n\u00eb Ministrin\u00eb e Drejt\u00ebsis\u00eb.<\/p>\n\n\n\n<p>Q\u00ebllimi i k\u00ebsaj rregulloreje \u00ebsht\u00eb krijimi i partnertitetit mes ANJF-s\u00eb dhe OJQ-s\u00eb p\u00ebrmes p\u00ebrcaktimit t\u00eb kritereve t\u00eb p\u00ebrgjithshme dhe t\u00eb ve\u00e7anta.<\/p>\n\n\n\n<p>Edhe akte t\u00eb tjera jan\u00eb duke pritur: Rregullorja p\u00ebr themelimin e Komisionit p\u00ebr Ankesa; Udh\u00ebzimi administrativ p\u00ebr tarifat dhe kompensimin e sh\u00ebrbimeve t\u00eb kryera nga avokat\u00ebt lidhur me sh\u00ebrbimet e autorizuara t\u00eb ndihm\u00ebs juridike falas; Udh\u00ebzimi administrativ p\u00ebr procedurat e angazhimit t\u00eb avokat\u00ebve n\u00eb sh\u00ebrbimet e autorizuara t\u00eb ndihm\u00ebs juridike falas; Udh\u00ebzimi administrativ p\u00ebr p\u00ebrmbajtjen e formularit p\u00ebr paraqitjen e k\u00ebrkes\u00ebs p\u00ebr ndihm\u00eb juridike falas.<\/p>\n\n\n\n<p>CEL Kosova ka treguar se funksionon n\u00eb baz\u00eb t\u00eb ligjeve pozitive q\u00eb rregullojn\u00eb statutin e OJQ-ve dhe se po ashtu ka nj\u00eb rregullore mbi konfidencialitetin.<\/p>\n\n\n\n<p>Nga CLARD Kosova \u00ebsht\u00eb b\u00ebr\u00eb e ditur se p\u00ebrve\u00e7 statutit dhe rregullores s\u00eb pun\u00ebs kan\u00eb edhe rregulloren per administrat\u00eb dhe financa dhe gjithashtu edhe rregulloren p\u00ebr sh\u00ebrbime juridike falas.<\/p>\n\n\n\n<p>Hulumtimi ka dashur t\u00eb nxjerr\u00eb n\u00eb pah edhe aspektin kuantitativ dhe kualitativ t\u00eb stafit t\u00eb k\u00ebtyre institucioneve q\u00eb ofrojn\u00eb ndihm\u00eb juridike falas.<\/p>\n\n\n\n<p>CEL Kosova ka treguar se p\u00ebr k\u00ebt\u00eb sh\u00ebrbim ka n\u00eb dispozicion edhe jurist\u00eb por edhe psikolog\u00eb t\u00eb kualifikuar. Rekrutimi n\u00eb k\u00ebt\u00eb organizat\u00eb b\u00ebhet sipas tenderimit publik.<\/p>\n\n\n\n<p>CLARD Kosovo aktualisht ka 7 jurist\u00eb me p\u00ebrvoj\u00eb pune prej 7 deri n\u00eb 12 vjet, dy me provim t\u00eb jurisprudenc\u00ebs dhe 15 avokat\u00eb bashk\u00ebpun\u00ebtor\u00eb t\u00eb jasht\u00ebm me sh\u00ebrbime&nbsp;<em>pro bono<\/em>. Politika e tyre e rekrutimit \u00ebsht\u00eb e mb\u00ebshtetur n\u00eb rregulloren e pun\u00ebs dhe Ligjin e pun\u00ebs.<\/p>\n\n\n\n<p>N\u00eb lidhje me p\u00ebrpjekjet p\u00ebr ngritje t\u00eb kapaciteteve t\u00eb stafit me profesionist\u00eb nga brenda apo jasht\u00eb organizat\u00ebs, ANJF ka treguar se zyra e personelit ka nd\u00ebrmarr\u00eb hapa p\u00ebr ngritjen profesionale t\u00eb stafit n\u00ebp\u00ebrmjet trajnimeve t\u00eb ndryshme, ku stafi \u00ebsht\u00eb certifikuar nga institucioni i specializuar Instituti i Administrat\u00ebs Publike i Kosov\u00ebs (IKAP). Por, ata tregojn\u00eb se duke marr\u00eb parasysh specifik\u00ebn e sh\u00ebrbimit t\u00eb ANJF-s\u00eb, trajnimet p\u00ebr stafin e ANJF-s\u00eb kan\u00eb qen\u00eb t\u00eb kufizuara. Theksojn\u00eb se stafi q\u00eb ofron sh\u00ebrbime juridike ka nevoj\u00eb p\u00ebr trajnime n\u00eb m\u00ebnyr\u00eb t\u00eb vazhdueshme p\u00ebr t\u00eb qen\u00eb koherent me k\u00ebrkesat dhe nevojat e qytetar\u00ebve. Po ashtu, Agjencia me p\u00ebrkrahjen e USAID-JAK ka trajnuar p\u00ebr trajner\u00eb stafin e brendsh\u00ebm, i cili, sipas vler\u00ebsimeve, ofron trajnime n\u00eb pun\u00eb p\u00ebr zyrtar\u00ebt.<\/p>\n\n\n\n<p>OJQ-t\u00eb nuk kan\u00eb p\u00ebrmendur trajnime t\u00eb tjera p\u00ebrve\u00e7 p\u00ebrgatitjes vetanake t\u00eb stafit.<\/p>\n\n\n\n<p>E pyetur lidhur me angazhimin e student\u00ebve, vullnetar\u00ebve, p\u00ebr t\u00eb kontribuar n\u00eb dh\u00ebnien e ndihm\u00ebs juridike falas, duke krijuar bashk\u00ebpunime dyansh\u00ebm frytdh\u00ebn\u00ebse, ANJF ka p\u00ebrmendur angazhimin e student\u00ebve p\u00ebr t\u00eb kryer praktik\u00ebn dhe kontribuar aty. N\u00eb baza vjetore p\u00ebrmes Jav\u00ebs s\u00eb Ndihm\u00ebs Juridike Falas kjo Agjenci promovon mund\u00ebsin\u00eb e student\u00ebve p\u00ebr t\u2019u angazhuar n\u00eb k\u00ebt\u00eb sh\u00ebrbim.<\/p>\n\n\n\n<p>CEL Kosova thot\u00eb se nuk ka vullnetar\u00eb t\u00eb angazhuar.<\/p>\n\n\n\n<p>CLARD Kosovo ka treguar se nj\u00eb nga shtyllat e misionit t\u00eb organizat\u00ebs \u00ebsht\u00eb mb\u00ebshtetja e jurist\u00ebve t\u00eb rinj n\u00eb kuad\u00ebr t\u00eb programit p\u00ebr praktik\u00eb p\u00ebrfshir\u00eb student\u00eb vendas dhe t\u00eb huaj. N\u00eb kuad\u00ebr t\u00eb strategjis\u00eb kan\u00eb num\u00ebruar edhe vullnetar\u00ebt profesionist\u00eb: avokat\u00eb, profesor\u00eb, gjyqtar\u00eb dhe prokuror\u00eb si dhe vullnetar\u00eb nga organizatat partnere nd\u00ebrkomb\u00ebtare.<\/p>\n\n\n\n<p>Por, marr\u00eb parasysh volumin e rasteve kombinuar me gjendjen socio-ekonomike n\u00eb vend, hulumtimi deshi t\u00eb nxjerr\u00eb n\u00eb drit\u00eb n\u00ebse ofruesit respektiv\u00eb kishin nj\u00eb politik\u00eb t\u00eb caktuar p\u00ebr m\u00ebnyr\u00ebn se si i trajtojn\u00eb rastet, m\u00eb sakt\u00ebsisht n\u00ebse nj\u00eb natyr\u00eb apo specifik\u00eb e caktuar u jep p\u00ebrpar\u00ebsi rasteve t\u00eb caktuara apo puna realizohet n\u00eb baz\u00eb t\u00eb parimit \u201c<em>i pari n\u00eb koh\u00eb, i pari n\u00eb t\u00eb drejt\u00eb<\/em>\u201d.<\/p>\n\n\n\n<p>ANJF me p\u00ebrkrahjen e USAID-it ka hartuar udh\u00ebzues p\u00ebr procesimin e rasteve p\u00ebr ndihm\u00eb juridike falas, n\u00eb t\u00eb cilin u jepet p\u00ebrpar\u00ebsi rasteve t\u00eb viktimave t\u00eb dhun\u00ebs dhe grupeve t\u00eb margjinalizuara. Po ashtu ka edhe&nbsp; Manualin e praktikuesve t\u00eb ndihm\u00ebs juridike n\u00eb Kosov\u00eb \u2013 \u00e7\u00ebshtjet civile, familjare dhe pasurore-juridike. Tani \u00ebsht\u00eb n\u00eb proces t\u00eb hartimit t\u00eb Manualit t\u00eb praktikuesve t\u00eb ndihm\u00ebs juridike n\u00eb Kosov\u00eb \u2013 \u00e7\u00ebshtjet administrative. CEL Kosova ka treguar se p\u00ebrpar\u00ebsi u jepet rasteve me rrezikshm\u00ebri m\u00eb t\u00eb lart\u00eb.<\/p>\n\n\n\n<p>Kurse te CLARD Kosovo politika e trajtimit dhe menaxhimit t\u00eb rasteve \u00ebsht\u00eb e rregulluar me rregulloren e pun\u00ebs dhe me rregulloren e sh\u00ebrbimeve juridike falas.<\/p>\n\n\n\n<p>Lidhur me sfidat q\u00eb vet\u00eb entitetet i shohin si m\u00eb t\u00eb v\u00ebshtirat, q\u00eb t\u00eb tria e identifikuan komponentin e q\u00ebndrueshm\u00ebris\u00eb financiare.<\/p>\n\n\n\n<p>ANJF ka num\u00ebruar pasojat e krijuara nga limitet financiare, duke p\u00ebrmendur pamund\u00ebsin\u00eb e shtrirjes s\u00eb drejt\u00eb dhe t\u00eb barabart\u00eb t\u00eb ndihm\u00ebs juridike falas n\u00eb t\u00eb gjitha komunat e Republik\u00ebs s\u00eb Kosov\u00ebs; avancimin e sistemit t\u00eb ndihm\u00ebs juridike falas n\u00eb drejtim t\u00eb unifikimit t\u00eb ndihm\u00ebs juridike falas n\u00eb t\u00ebr\u00eb vendin; numri i pamjaftuesh\u00ebm i stafit; sensibilizimin dhe vet\u00ebdijesimin e publikut, ve\u00e7mas i grupeve t\u00eb interesit, p\u00ebr sh\u00ebrbimet q\u00eb u ofrohen nga ANJF-ja; sigurimin e mjeteve buxhetore p\u00ebr aft\u00ebsimin profesional t\u00eb stafit; sigurimim e mjeteve buxhetore p\u00ebr zbatimin e plot\u00ebsim ndryshimit t\u00eb Ligjit p\u00ebr ndihm\u00eb juridike falas si dhe sigurimin e hap\u00ebsirave t\u00eb pun\u00ebs p\u00ebr ANJF-n\u00eb n\u00eb Prishtin\u00eb n\u00eb objektet publike.<\/p>\n\n\n\n<p>Nd\u00ebrsa CEL Kosova po ashtu e identifikoi problematike munges\u00ebn e nj\u00eb hap\u00ebsire t\u00eb veten.<\/p>\n\n\n\n<p>Marr\u00eb parasysh se si shtet i ri ne n\u00eb vazhdim\u00ebsi kemi \u201cp\u00ebrfituar\u201d nga p\u00ebrvojat e shteteve t\u00eb tjera, pjes\u00eb e hulumtimit ishte edhe d\u00ebshira p\u00ebr t\u00eb ditur n\u00eb lidhje me modele homologe t\u00eb shfryt\u00ebzuara.<\/p>\n\n\n\n<p>Zyrtar\u00ebt e ANJF pohojn\u00eb se p\u00ebrcjellin ndihm\u00ebn juridike falas t\u00eb vendeve t\u00eb ndryshme nd\u00ebrkomb\u00ebtare dhe kan\u00eb vrojtuar se \u00ebsht\u00eb p\u00ebr t\u2019u marr\u00eb model buxheti i caktuar p\u00ebr kok\u00eb banori. Ata thon\u00eb se sa u p\u00ebrket vendeve fqinje, krahasimisht mendojn\u00eb se Republika e Kosov\u00ebs ka sistemin m\u00eb t\u00eb mir\u00eb t\u00eb ndihm\u00ebs juridike falas. CEL Kosova ka treguar vet\u00ebm se modelet e organizatave homologe i kombinon dhe i p\u00ebrshtat n\u00eb kontekst t\u00eb vendit ton\u00eb. Kurse, CLARD Kosovo, e cila ka nj\u00eb p\u00ebrvoj\u00eb t\u00eb gjat\u00eb n\u00eb ofrimin e k\u00ebtij sh\u00ebrbimi, ka treguar se meqen\u00ebse n\u00eb periudh\u00ebn kur organizata ka filluar aktivitetet nuk ka pasur ndonj\u00eb organizat\u00eb apo institucion vendor i cili ka ofruar sh\u00ebrbime juridike falas, si model t\u00eb pun\u00ebs i kan\u00eb marr\u00eb organizatat nga vendet e Bashkimit Evropian dhe SHBA.<\/p>\n\n\n\n<p>Ani pse sh\u00ebrbimi ofrohet falas cil\u00ebsia e tij nuk vihet n\u00eb diskutim n\u00eb shtetet me sisteme juridike t\u00eb avansuara.<\/p>\n\n\n\n<p>Sipas ANJF, bazuar n\u00eb rezultatet e kutive t\u00eb k\u00ebnaqshm\u00ebris\u00eb s\u00eb pal\u00ebve, rezulton se k\u00ebnaqshm\u00ebria n\u00eb 2 vitet e fundit \u00ebsht\u00eb mbi 96 %.<\/p>\n\n\n\n<p><strong>\u00c7ka \u00ebsht\u00eb ndihma juridike falas?<\/strong><\/p>\n\n\n\n<p>Ndihma juridike falas \u00ebsht\u00eb nj\u00eb obligim nd\u00ebrkomb\u00ebtar p\u00ebr shtetet q\u00eb n\u00ebp\u00ebrmjet saj t\u00eb sigurojn\u00eb qasje efektive n\u00eb drejt\u00ebsi p\u00ebr t\u00eb gjith\u00eb ata qytetar\u00eb q\u00eb nuk kan\u00eb mund\u00ebsi financiare p\u00ebr ta siguruar at\u00eb.<\/p>\n\n\n\n<p>Kategorit\u00eb t\u00eb cilat p\u00ebrfitojn\u00eb nga kjo ndihm\u00eb, parimisht shtet\u00ebrore, jan\u00eb t\u00eb parapara me ligj. Por, kurdoher\u00eb q\u00eb interesi i drejt\u00ebsis\u00eb e k\u00ebrkon q\u00eb kjo ndihm\u00eb t\u2019u jepet inidivd\u00ebve t\u00eb caktuar ajo jepet pavar\u00ebsisht k\u00ebtyre kategorive.<br>N\u00eb Bashkimin Evropian r\u00ebnd\u00ebsia dhe funksioni i k\u00ebtij sh\u00ebrbimi nuk vihet n\u00eb diskutim. Por nuk ekzistojn\u00eb standarde apo kritere t\u00eb unifikuara mes tyre n\u00eb k\u00ebt\u00eb segment ndaj dhe \u00ebsht\u00eb e pamundur t\u00eb matet dhe t\u00eb b\u00ebhet vler\u00ebsimi i cil\u00ebsis\u00eb s\u00eb ofrimit t\u00eb sh\u00ebrbimit brenda dhe midis vendeve t\u00eb ndryshme.<br>Sipas rregullimit ligjor n\u00eb vendin ton\u00eb, ndihma juridike falas p\u00ebrfshin: informatat dhe k\u00ebshillat juridike lidhur me procedurat ligjore; p\u00ebrpilimin e shkresave dhe t\u00ebr\u00eb asistenc\u00ebn tjet\u00ebr teknike q\u00eb ka t\u00eb b\u00ebj\u00eb me kompletimin e l\u00ebnd\u00ebs; dhe p\u00ebrfaq\u00ebsimin n\u00eb procedur\u00ebn civile, penale, administrative dhe kund\u00ebrvajt\u00ebse.<\/p>\n\n\n\n<p><strong>Korniza juridike e Kosov\u00ebs sa i p\u00ebrket dh\u00ebnies s\u00eb ndihm\u00ebs juridike<\/strong><\/p>\n\n\n\n<p>Ndihma juridike falas n\u00eb Kosov\u00eb jepet n\u00eb p\u00ebrputhshm\u00ebri me Konvent\u00ebn Evropiane p\u00ebr t\u00eb Drejtat e Njeriut, sipas t\u00eb cil\u00ebs \u2018e drejta n\u00eb ndihm\u00eb juridike falas \u00ebsht\u00eb e garantuar n\u00eb rastet kur i akuzuari nuk ka mjete t\u00eb mjaftueshme p\u00ebr t\u00eb paguar p\u00ebr ndihm\u00eb juridike dhe n\u00eb rastet kur interesi i drejt\u00ebsis\u00eb e k\u00ebrkon\u2019, dhe po ashtu me Kart\u00ebn e t\u00eb Drejtave Fundamentale t\u00eb Bashkimit Evropian.<br>Kur flasim p\u00ebr legjislacionin vendor, ajo e ka burimin nga akti m\u00eb i lart\u00eb juridik i vendit \u2013 Kushtetuta e Republik\u00ebs s\u00eb Kosov\u00ebs, e cila e p\u00ebrcakton Ligjin p\u00ebr ndihm\u00eb juridike falas si aktin kryesor rregullues t\u00eb saj.
